New Zealand residents aged 12 years or older. A claimant under 18 years of age must have the consent of their parent or legal guardian to participate, and the Promoter may require evidence of that consent.
During the Purchase Period, purchase one or more Participating Products in a single transaction from any New Zealand pharmacy or retailer that stocks and sells the Participating Products. Purchases may be made in-store or online.
One claim and one Gift per person during the Promotion Period with a Qualifying Purchase. Only one claim and one Gift will be permitted per person, regardless of the number of Participating Products purchased or the number of receipts or tax invoices submitted.
One 700mL double-wall vacuum drink bottle made from recycled stainless steel, with a flip-top lid and secure push-button release, fast-flowing chug spout, foldaway carry handle and durable matte powder-coated finish.
A total of 1,000 Gifts are available while stocks last. Gifts will be allocated in the order valid claims are received and approved by the Promoter. Submission of a claim does not guarantee that a Gift remains available.
The Promoter will pay standard delivery costs to a valid New Zealand delivery address provided by the claimant. Allow up to three working weeks after validation of the claim for delivery.
These Conditions of Claim include the Schedule above. By submitting a claim, the claimant is deemed to have read, accepted and agreed to be bound by these Conditions of Claim. Capitalised terms have the meanings given in the Schedule unless stated otherwise.
- Promotion period and availability. The Promotion is available only during the Purchase Period and Claim Period stated in the Schedule. Claims are deemed received when recorded as received by the Promoter or its appointed agency, not when transmitted by the claimant. Valid claims will be accepted only while stocks last.
- Eligibility. Claims are open only to Eligible Claimants. If a claimant is under 18 years of age, the claimant must have the consent of a parent or legal guardian before participating. The Promoter may request reasonable evidence of age, New Zealand residency or parent or guardian consent. If satisfactory evidence is not provided, the claim may be invalidated.
- Excluded persons. Employees, and their immediate family members, of the Promoter, participating retailers, the Promoter’s distributors, and agencies, suppliers or companies directly associated with conducting or fulfilling the Promotion are not eligible to claim. “Immediate family member” means spouse, de facto partner, parent, step-parent, child, step-child, sibling, step-sibling, grandparent or grandchild.
- Proof of Purchase. Each claim must be supported by separate valid Proof of Purchase for a separate Qualifying Purchase transaction. For an in-store purchase, Proof of Purchase must be an itemised receipt. For an online purchase, an itemised tax invoice issued by the New Zealand retailer is acceptable. Proof of Purchase must clearly show the retailer, the Participating Product, the purchase date and sufficient transaction details to verify the Qualifying Purchase. The purchase must have occurred during the Purchase Period and before the claim was submitted.
- One claim per transaction. Only one claim and one Gift are permitted per Qualifying Purchase transaction, even if multiple Participating Products appear on the same receipt or tax invoice. A claimant may make additional claims for separate transactions, with separate valid Proof of Purchase for each claim. A receipt or tax invoice used for one accepted claim cannot be used again.
- Claim validation. The Promoter may verify the authenticity and eligibility of any claim, claimant details and Proof of Purchase. The Promoter may request an original or further copy of Proof of Purchase or other reasonable supporting information. Incomplete, incorrect, illegible, indecipherable, late, duplicated, altered or fraudulent claims may be deemed invalid. The use of automated claim software or any mechanical or electronic means that enables repeated automated claims is prohibited.
- Gift allocation. There are 1,000 Gifts in total. Gifts are available while stocks last and will be allocated in the order valid claims are received and approved. A submitted or provisionally acknowledged claim does not reserve or guarantee a Gift. Once all Gifts have been allocated, no further claims will be fulfilled.
- Gift conditions. The Gift is not transferable or exchangeable and cannot be redeemed for cash, credit or any other product. The Gift cannot be substituted. If the advertised Gift is unavailable because all 1,000 Gifts have been allocated, no alternative gift will be provided, subject always to any rights that cannot be excluded by law. Product colours, finishes and appearance may vary slightly from promotional images.
- Delivery. The Promoter will arrange and pay for standard delivery of an approved Gift to the valid New Zealand delivery address submitted with the claim. The claimant is responsible for providing complete and accurate delivery details. Allow up to three working weeks after the claim has been validated for delivery. The Promoter may contact the claimant using the details supplied if further information is reasonably required to validate or fulfill the claim.
- Damaged Gifts. If a Gift is received damaged, the claimant must notify the Promoter within 14 calendar days after delivery using the contact details in the Schedule. The claimant must provide reasonable evidence of the damage, including photographs if requested, and retain the Gift and its packaging while the matter is assessed. Following verification, the Promoter will provide an appropriate remedy in accordance with applicable law.
- Claimant identity. A claim must be submitted in the claimant’s own name. If there is a dispute about the identity of a claimant or the validity or timing of a claim, the Promoter may determine the matter acting reasonably and by reference to its records and supporting evidence.
- Privacy. The Promoter, or its agents and contractors acting on its behalf, will collect the claimant’s first and last name, email address, mobile number, New Zealand delivery address, retailer, purchase date and uploaded Proof of Purchase. This information will be used to administer the Promotion, validate claims, communicate with claimants and arrange delivery. It may be disclosed to related entities, fulfilment providers, couriers, technology providers and other contractors where reasonably necessary for those purposes. Participation does not constitute consent to receive unrelated marketing communications. If the requested information is not provided, the Promoter may be unable to validate or fulfill the claim.
- Privacy rights. Personal information will be handled in accordance with the Promoter’s Privacy Policy at https://inovaconnect.com.au/privacy/. The Privacy Policy explains how individuals may seek access to, or correction of, personal information held about them and how to raise a privacy concern.
- Consumer rights. Nothing in these Conditions of Claim excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified, including rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020.
- Changes or cancellation. If any aspect of the Promotion cannot run as reasonably intended for reasons beyond the Promoter’s control, including technical failure, communications network failure, tampering, unauthorised intervention, fraud, supply interruption or events affecting safe or lawful fulfilment, the Promoter may modify, suspend or cancel the Promotion to the extent reasonably necessary and permitted by law. Any change will not affect rights already accrued under valid approved claims, except where required by law or circumstances beyond the Promoter’s reasonable control.
- Disqualification and disputes. The Promoter may disqualify a claim where the claimant has not complied with these Conditions of Claim or has provided false, misleading or fraudulent information. The Promoter will seek to resolve any dispute directly with the claimant. If it cannot be resolved, the Promoter’s decision, acting reasonably and subject to applicable law, will be final.
- Liability. To the maximum extent permitted by law, the Promoter and its associated agencies and companies will not be liable for indirect or consequential loss arising in connection with the Promotion or use of the Gift. This does not exclude liability that cannot be excluded by law, or liability to the extent caused or contributed to by the Promoter.
- General. The Promotion is not valid in conjunction with any other offer unless expressly stated. Failure by the Promoter to enforce any right at any stage does not constitute a waiver of that right. If any provision of these Conditions of Claim is held to be invalid or unenforceable, the remaining provisions continue to apply.
